PRIVACY POLICY

§ 1 General

Your personal data (e.g. title, name, address, e-mail address, telephone number, bank details, credit card number) will only be processed by us in accordance with the provisions of German data protection law and the data protection laws of the European Union (EU). In addition to the processing purposes, recipients, legal bases, storage periods, the following provisions also inform you about your rights and the data controller for your data processing. This privacy policy only applies to our websites. If you are redirected to other sites via links on our pages, please refer to these sites for information on how they handle your data.

§ 2 Data processing for fulfilment of the contract

(1) Processing purpose

Your personal data, which you make available to us in the ordering process, is required for the conclusion of a contract with us. You are not obliged to provide your personal data. However, we cannot send you the goods unless you provide us with your address. For some payment methods, we require the necessary payment data in order to provide them to a payment service provider that we have commissioned. The processing of your data entered in the ordering process is therefore for the purpose of fulfilling the contract.

If you send us an enquiry by e-mail, via a contact form etc. before the contract is concluded, we process the data obtained in this way to carry out pre-contractual measures and answer, for example, your questions regarding our products.

(2) Legal basis

The legal basis for this processing is Art. 6 para. 1 b) GDPR.

(3) Categories of recipients

Payment service providers, shipping service providers, hosting providers, possibly merchandise management system, possibly suppliers (dropshipping).

(4) Storage duration

We store the data required for the execution of the contract until the expiry of the statutory warranty and, if applicable, contractual warranty periods.

We retain the data required under commercial and tax law for the periods of time specified by law, regularly ten years (cf. § 257 of the German Commercial Code [“HGB”], § 147 AO).

The data processed to carry out pre-contractual measures will be deleted as soon as the measures have been carried out and it is evident that no contract will be concluded.

§ 3 Comments

(1) Processing purpose

It is possible to write a comment. Your data (e.g. name/pseudonym, e-mail address, website) will then only be processed for the purpose of publishing your comment.

(2) Legal basis

The legal basis for this processing is Art. 6 para. 1 f) GDPR.

(3) Legitimate interest

Our legitimate interest is the public exchange of user opinions on specific topics and products. Among other things, the publication serves the purpose of transparency and opinion forming. Your interest in privacy is preserved, as you are able to publish your comment under a pseudonym.

(4) Storage duration

A specific storage duration is not defined. You can request the deletion of your comment at any time.

(5) RIGHT TO OBJECT

You have the right to object at any time, for reasons arising from your particular situation, to the processing of data which is carried out on the basis of Art. 6 para. 1 f) GDPR and not for the purpose of direct advertising.

In the case of direct advertising, however, you may object to the processing at any time without giving reasons.

§ 5 Information on cookies

(1) Processing purpose

Technically necessary cookies are used on this website. These are small text files that are stored in or by your Internet browser on your computer system. These cookies enable e.g. the insertion of several products into a shopping basket.

(2) Legal basis

The legal basis for this processing is Art. 6 para. 1 f) GDPR.

(3) Legitimate interest

Our legitimate interest is the functionality of our website. The user data collected through technically necessary cookies is not used to create user profiles. This ensures that your interest in privacy is protected.

(4) Storage duration

The technically necessary cookies are usually deleted when the browser is closed. Permanently stored cookies have a varying lifetime from a few minutes to several years.

(5) RIGHT TO OBJECT

If you do not wish these cookies to be stored, please disable the acceptance of these cookies in your Internet browser. However, this may result in a functional limitation of our website. You can also delete permanently stored cookies at any time via your browser.

§ 6 Your rights as a data subject

If your personal data is processed, you are a data subject within the meaning of the GDPR and you are entitled to the following rights in relation to us as the data controller:

1. Right to information

Within the scope of Art. 15 GDPR, you can request information concerning your personal data processed by us.

2. Right to rectification

If the information concerning you is not (no longer) correct, you can request that this information be rectified in accordance with Art. 16 GDPR. If your data is incomplete, you can request that it be completed.

3. Right to deletion

You can request the deletion of your personal data under the conditions of Art. 17 GDPR.

4. Right to restriction of processing

Within the scope of the provisions of Art. 18 of the GDPR, you have the right to request that the processing of data concerning you be restricted.

5. Right to data portability

In accordance with Art. 20 of the GDPR, you have the right to receive the personal data concerning you that you have provided us with in a structured, common and machine-readable format or to request that it be transferred to another responsible party.

6. Right to revoke the declaration of consent under data protection law

In accordance with Art. 7 para. 3 GDPR, you have the right to revoke your declaration of consent under data protection law at any time. This does not affect the lawfulness of the processing carried out on the basis of the consent until revocation.

7. Right of appeal to a supervisory authority

If you believe that the processing of personal data relating to you is in breach of the GDPR, you have the right to lodge a complaint with a supervisory authority (in particular in the Member State in which you are domiciled, your place of work or the place of the suspected breach) under Article 77 of the GDPR.

Please also note your right to object under Art. 21 GDPR:

a) General: reasoned opposition required

If the processing of personal data relating to you is carried out

- to safeguard our overriding legitimate interest (legal basis pursuant to Art. 6 para. 1 f) of the GDPR) or

- in the public interest (legal basis pursuant to Art. 6 para. 1 e) of the GDPR),

you have the right to object to the processing at any time for reasons arising from your particular situation; this also applies to profiling based on the provisions of the GDPR.

In the event of an objection, we will no longer process the personal data concerning you, unless we can prove compelling reasons for processing that are worthy of protection and outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

b) Special case of direct marketing: simple objection is sufficient

Where the personal data concerning you is processed for the purpose of direct marketing, you have the right to object, at any time and without giving any reason, to such processing, including profiling where it is linked to such direct marketing.

If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.
